    1 By completing the join process online, you agree to be bound by the terms and conditions below.

    2. By verbally agreeing to our offer (or any discounted offer) from one of our sales staff, this constitutes “offer and acceptance” and you agree to be bound by the terms and conditions below.

    3. ANNUAL SUBSCRIPTION: The annual subscription must be paid within 7 days of invoicing.

    3a. The 12 Month subscription starts from the date of verbal agreement.

    3b. The verbal acceptance is binding, regardless of whether your listing is created prior to payment or not. It is at Home Giraffe’s discretion to create advertisements once verbally agreed upon, and prior to payment.

    3c. In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.

    4. MONTHLY PAYMENTS: Where the arrangement is monthly payments, this fee is paid monthly and in advance
     

    4a. Payment is direct debit from your nominated Credit Card account.

    4b. This charge is ongoing until the user terminates their contract with Home Giraffe.

    5. ACCOUNT TERMINATION: Termination must be done in writing by email to service@homegiraffe.com.au should the user wish to terminate their account.

     
    5a. Termination can only occur after the minimum 12 month contract.
    5b. The user will be charged for the full final month, regardless of the timing of their termination within that month.6: REFUNDS: No refunds are given.

     

    7. OUR TERMINATION RIGHTS:  Home Giraffe reserves the right to terminate any account at our discretion. No arguments will be entered into.

    7a. Should your account be flagged for termination, you will be notified via email, and charges will no longer be incurred.

    8. Payment is for advertising on Home Giraffe with the company profile listing you selected.

    9. LATE PAYMENTS: Should your payment method reject our debit authority, we reserve the right to suspend your account until the bill is paid. We reserve the right to impose late payment penalties.

    10. ACCOUNT USAGE: The advertiser is responsible for content and maintenance of their listing. The advertiser is responsible for creating their own page, not Home Giraffe. Home Giraffe, its staff, and directors accept no liability for the content or accuracy of information on your business listing page.

    10a. Home Giraffe takes no responsibility for the content uploaded by any individual user.

    10b. Home Giraffe reserves the right to remove, revise or refuse any advertising material.

    11. INTELLECTUAL PROPERTY: All intellectual property in relation to material used in the website, the method and web templates, logos and the name Home Giraffe and Homegiraffe.com.au belongs to Home Giraffe and its parent trust.

    12. UPDATES: Home Giraffe may change and update these terms and conditions at any time. Updated versions will be immediately posted to the Home Giraffe website for viewing. You accept full responsibility for regularly viewing and checking the terms and conditions for any changes. Your continued use of Home Giraffe after any changes are made constitutes your acceptance of those changes.

    13. SITE USERS: By using Home Giraffe you acknowledge that we, Home Giraffe are not involved in the transactions between your business and the consumer. As the advertiser, we have no control over the workmanship, safety, quality or legality of either the companies who advertise with us, or the content of which they post.14. Home Giraffe can not and does not confirm each business’ identity. We do provide a feedback system within our website.

     

    15. In the event that you have a dispute with another user of the Home Giraffe website, you release Home Giraffe, and our staff, directors, agents, subsidiaries, and affiliates from claims, demands and damages of every kind and nature.

    16. By signing up to our newsletter you agree and accept to receiving emails from Home Giraffe.

    17. Any controversy or claim arising from a dispute between an advertiser and a site user is entirely between those two parties. Home Giraffe accepts no involvement and you agree as terms of use to release Home Giraffe from any such disputes.18. FEEDBACK: Users may not deliberately and unfairly undermine or sabotage the integrity of the “5 star rating” score system.

     

    19. Users of Home Giraffe should be careful leaving feedback on companies. Users must ensure that the rating and feedback are fair, and honest.

    20. Home Giraffe reserves the right to remove any rating or comment at its discretion.

    ADDITIONAL INFORMATION FOR BUSINESSES

     
    21. We do not offer a free trial as of December 2013
     
    22. It is a condition upon taking any annual special that upon completion of the full year it will revert back to the advertised $39 per month plan automatically.
     
    23. For special yearly payment offers the onus is on the company listing on Home Giraffe to create their page once payment is processed.
     
    WEBSITES:
    24. In the event you have paid a deposit for us to build a website, you shall forfeit that deposit if 60 days has elapsed without responding to our requests for information to complete said website.
     
    25. Payment of the deposit triggers our contractors and constitutes accepance of the website terms 24 to 28.
     
    26. Upon completion the balance owing on the website must be paid in full.
     
    27. In the event of disputes on completion the website must be paid in full and Home Giraffe and its contractors have first right to rectify. This falls under clause 28 below.
     
    28. Upon practical completion of the website we offer a 30 day support period.
